Benefits offered by the FundMedical Benefits

A person involved in a motor vehicle accident is entitled to medical treatment amounting up to N$ 1,500,000.00 which provides for medical treatment, injury management, rehabilitation and life enhancement

Injury Grant

The Fund provides an injury grant to the value of up to N$ 100 000.00 depending on the severity of the injuries sustained. This is a cash grant that serves as compensation for injury in respect of any one injured person (This is money paid for the pain, suffering and loss of amenities of life).

Funeral Grant

The Fund provides a funeral benefit to the value of N$ 7 000.00 in respect of any person who died in a motor vehicle accident.

Loss of income

Loss of income to the value of N$ 100 000 per annum in respect of any one injured person where there is proof that the person paid income tax for the tax year prior to the injury or for most of a five year period immediately preceding the injury may be claimed.

In all other cases, the maximum amount payable will be the proven amount of actual loss suffered.

Loss of support

Loss of support may be claimed by a depended of a deceased in the case where there is proof that the deceased paid tax on income for the tax year preceding the injury or for most of a five year period immediately preceding death, to a share calculated on income assured to be no more that N$ 100 000 per annum – in all other cases, a share calculated on income assumed to be no more that the amount set as tax threshold per annum.

Limitations of the Fund:

  • If a person claiming benefits has contributed to the accident, injury or death giving rise to the claim, any monetary award, otherwise payable is reduced in proportion to such contribution.
  • If a person was injured whilst he/she was not wearing a seat belt at the time of the accident, the monetary benefits otherwise payable is reduced by 25%;
  • If an accident victim injured when he/she was being conveyed in a goods vehicle/ bakkie at the time of the accident, the monetary benefits otherwise payable is reduced by up to 50%;
  • If a person was injured when he/she was being conveyed in a vehicle which was overloaded, the benefits otherwise payable is reduced by up to 50%.

Can foreigners claim from the Fund:

Any person who is in Namibia in accordance with a visitor permit under the immigration control Act; and Section 14 of the Namibia Refugees Act is limited to providing medical treatment and injury management for the period such person is in Namibia

Or

In respect of a person killed in a motor vehicle accident and who is not granted right of residence in Namibia or either has the right to remain in Namibia in accordance with the Namibia refugees Act is limited to providing funeral benefit of N$ 7 000.00.

Who is excluded from benefitting from the Fund?

If a person unreasonably refuses or fails to:

  • Submit a duly completed claim to the Fund;
  • On request of the Fund, to furnish a document or information relevant to the claim.
  • If the person is guilty of driving the motor vehicle involved in the accident whilst under the influence of intoxicating liquor (drunken driving);
  • If the person did not hold a valid drivers license or he/she is the holder of a learner’s license or any other restricted license issued under that law, failed to comply with conditions of that particular license;
  • If the person is the owner of a motor vehicle involved in an accident being driven by a person who is not the holder of a license.
  • If the person has willfully driven the motor vehicle involved in the motor vehicle accident knowing that it has been stolen.
  • If the person has driven the motor vehicle or is being conveyed in the motor vehicle during the course of committing a serious criminal offence unless such a person has driven the vehicle or is being conveyed in the vehicle against his/her will and did not take part in the committing of such an offence.
  • If the claimant in making the claims provides false information, or withholds information, calculated to mislead the Fund in making a determination on the claim.

What is the time-frame within which I can claim?

  • The Fund upon notification can serve the claimant with a notice to claim within 90 days.
  • A claim can be submitted one year from the date of the accident.
