The MVA Fund embarked on a series of public consultations across the country on the proposed amendments to the Motor Vehicle Accident Fund Act, 2007 (No 10 of 2007). The sessions started on 17 July 2025, with the last one scheduled to take place on 5 September 2025.
The envisioned amendments aim to address various aspects, including the scope of benefits, claims procedures, governance structures, and the overall effectiveness of the Fund’s operations.
According to the MVA Fund CEO, Rosalia Martins-Hausiku the Fund has been in consultation with the law reform over the past 10 years to accommodate the new proposed changes aimed to remove legal “grey areas” that hinder implementation and ensure effective service delivery.
Under the proposed law reform, the Fund seeks to have the following adopted into the new Act:
- Provision for additional revenue streams for the Fund in the form of levies for foreign and locally registered vehicles and an electric vehicle levy;
- Eliminate monetary values of benefits from the Act and to empower the Minister to determine such values by way of Regulation;
- Introduce new exclusions to benefits, define the eligibility of dependents of deceased breadwinners to claim for loss of support benefits;
- Define and clarify the different periods of prescription and the category of claimants those will apply to broaden the instances that interrupt the running of prescription against a claimant;
- Expand the grounds for the Fund to exercise its right of recourse against guilty drivers; and to provide for or enable an efficient administrative process.
- Propose the removal for limitation of 50% reduction of benefit claims like loss of income and injury grant for passengers conveyed in pick-up vehicles, canopies or cars that cannot be fully affixed with seats and seatbelts.
